1. Acceptance of Terms

By downloading, installing, accessing, or using Casino Compass (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not download, install, or use the App.

These Terms constitute a legally binding agreement between you and Casino Compass, LLC (“we,” “us,” “our,” or “Company”).

2. Eligibility

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

Important: While the App provides navigation within casino properties, Casino Compass is NOT a gambling application. We do not facilitate, promote, or enable any gambling activities. The App is a navigation and information tool only.

3. Intellectual Property Rights

3.1 Our Ownership

All content in the App, including but not limited to:

Interior casino maps and floor plans
Venue data, descriptions, and hotspot information
Graphics, logos, icons, and user interface designs
Software code, algorithms, and routing systems
The “Chip” mascot character and all associated artwork
Text, images, audio, and other creative content
Database compilations and arrangements

...is the exclusive property of Casino Compass, LLC and is protected by United States and international copyright laws, trademark laws, trade secret laws, and other intellectual property rights.

3.2 Copyright Notice

All maps, floor plans, venue data, and related content are original works created by Casino Compass, LLC.

Our maps are NOT derived from casino-provided materials. They are independently created through professional surveying, AI verification, and continuous human quality assurance.

3.3 Trademark Notice

“Casino Compass,” the Casino Compass logo, “Chip” (our AI mascot), and related marks are trademarks or registered trademarks of Casino Compass, LLC. You may not use our trademarks without prior written permission.

3.4 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

Download and install the App on your personal mobile device
Use the App for personal, non-commercial navigation purposes
View maps and content within the App interface

This license does NOT include any right to:

Copy, reproduce, distribute, or republish any maps or content
Create derivative works based on our content
Use our content for any commercial purpose
Reverse engineer, decompile, disassemble, or attempt to derive source code from the App
Extract data through automated means (scraping, bots, crawlers, spiders, etc.)
Remove, alter, or obscure any copyright notices, watermarks, or proprietary markings
Sublicense, sell, rent, lease, or transfer the App or any content
Use the App to create a competing product or service

4. Prohibited Uses

You agree NOT to:

4.1 Content Theft and Misuse

Screenshot, photograph, or capture maps for redistribution, publication, or commercial use
Use our maps in competing applications, websites, or services
Share, sell, license, or distribute our content to third parties
Create databases, collections, or compilations using our venue data
Incorporate our content into AI training datasets or machine learning models
Frame, mirror, or embed any portion of the App on external websites

4.2 Technical Abuse

Use automated tools, scripts, or bots to access the App
Attempt to bypass, circumvent, or disable any security features
Interfere with or disrupt the App's servers or networks
Introduce viruses, malware, or other harmful code
Attempt to gain unauthorized access to any systems or data
Probe, scan, or test the vulnerability of the App

4.3 Harmful Conduct

Use the App for any illegal purpose
Harass, threaten, or harm other users
Impersonate any person or entity
Submit false, misleading, or fraudulent information
Interfere with other users' enjoyment of the App

5. User Conduct and Contributions

5.1 Personal Use Only

The App and its content are provided exclusively for your personal navigation and information purposes. Any commercial use, including but not limited to use by competing mapping services, tour operators, or venue consultants, requires prior written licensing agreement with Casino Compass, LLC.

5.2 Screenshots and Personal Sharing

You may take screenshots for:

Personal reference while navigating
Sharing your location with friends or family via private messages
Personal trip planning purposes

You may NOT:

Post maps to blogs, websites, or public social media for commercial purposes
Use screenshots in promotional materials, presentations, or publications
Remove or obscure copyright notices in any reproduction
Imply endorsement, partnership, or affiliation without authorization

5.3 Crowdsourced Contributions

If you choose to submit feedback, corrections, or validation data through our crowdsourcing features:

You grant us a perpetual, worldwide, royalty-free license to use your submissions
You represent that your submissions are accurate and made in good faith
You agree not to submit false, malicious, or spam content
We reserve the right to reject, modify, or remove any submission
We are not obligated to use or implement your suggestions

6. AI Concierge (“Chip”) Feature

6.1 Nature of AI Assistance

The “Chip” AI concierge provides automated recommendations and assistance. Chip's responses are generated by artificial intelligence (powered by OpenAI) and should be treated as suggestions, not professional advice.

6.2 Limitations

Chip may occasionally provide inaccurate or outdated information
Recommendations are based on limited context and may not suit your specific needs
Chip does NOT have access to real-time venue availability, wait times, or pricing
AI responses do not constitute endorsements of any venues or services

6.3 User Responsibility

You are solely responsible for decisions made based on Chip's recommendations. Always verify important information (reservations, hours, availability) directly with venues.

7. Gamification and Rewards

7.1 Casino Points (CP)

The App includes a gamification system with an in-app virtual currency called “Casino Points” or “CP.” You can earn CP through:

Daily app usage grants
Completing achievements and badges
Route validation and feedback submissions
Referral program participation
Special events and promotions

IMPORTANT: CP is virtual currency with NO monetary value. CP:

Cannot be exchanged for cash, gift cards, or real-world currency
Cannot be transferred to other users
Cannot be sold, traded, or purchased
Has no value outside the App
May be forfeited upon account termination or App deletion

7.2 Achievements and Badges

The App awards achievements and badges for various activities. These are for entertainment purposes only and confer no rights, benefits, or value outside the App.

7.3 High Limit Mode

“High Limit Mode” is a time-limited feature that doubles CP earnings for 24 hours. It can be activated by spending 500 CP or through referral program rewards. High Limit Mode:

Is a virtual feature with no real-world value
Expires automatically after 24 hours
Cannot be paused, extended, or refunded
May be modified or discontinued at any time

7.4 Referral Program

You may earn CP by referring new users to the App. Referral terms:

You receive 100 CP when a referred user completes qualifying actions
Referred users receive 50 CP as a welcome bonus
Daily referral limits may apply
We reserve the right to void rewards obtained through fraud, abuse, or violation of these Terms
Referral rewards cannot be combined with other promotions unless stated
We may modify or discontinue the referral program at any time

7.5 Modifications to Rewards

We reserve the right to modify, suspend, or discontinue any aspect of the gamification system, including CP values, earning rates, redemption options, and achievement criteria, at any time without notice.

8. Push Notifications and Communications

8.1 Types of Notifications

With your permission, we may send push notifications including:

Navigation assistance and route updates
Chip AI suggestions and recommendations
Achievement unlocks and reward notifications
Trip reminders (if you provided your email)
App updates and new feature announcements
Promotional content and special offers

8.2 Notification Consent

Push notifications require your explicit consent through iOS system permissions. You may:

Decline notifications during initial setup
Disable notifications at any time in iOS Settings
Manage notification preferences within the App

8.3 Email Communications

If you provide your email address for trip reminders, you consent to receiving:

Trip planning reminders before your visit
Feature updates and tips
Promotional communications

You may unsubscribe from email communications at any time via the unsubscribe link in any email or through App settings.

9. Third-Party Services and Links

9.1 Affiliate Partners

The App integrates with third-party booking and ticketing services including OpenTable, Ticketmaster, and potentially others. When you tap a booking button:

You will be redirected to the third party's website or app
The third party's terms of service and privacy policy will govern your interaction
Casino Compass is not responsible for third-party services, content, or transactions
We do not guarantee availability, pricing, or fulfillment of bookings made through partners

9.2 Rideshare Integration

The App provides deep links to rideshare services including Uber and Lyft for transportation convenience. When using rideshare features:

You will be redirected to the Uber or Lyft app (or App Store if not installed)
Rideshare services are provided entirely by Uber and Lyft, not Casino Compass
All rideshare transactions, pricing, and service quality are governed by Uber's or Lyft's terms
Casino Compass is not responsible for rideshare availability, pricing, driver conduct, or service issues
We do not receive or process any payment information for rideshare services

9.3 External Links

The App may contain links to third-party websites, apps, or services. We do not control and are not responsible for the content, privacy practices, or availability of external sites. Links do not imply endorsement.

9.4 Sponsored Content

Some content in the App may be sponsored by venue partners. Sponsored content is clearly labeled and does not affect the accuracy of our maps or navigation. Sponsored venues are not given preferential routing.

9.5 Advertising

In limited circumstances, the App may display advertisements served by Google AdMob when no sponsored content or affiliate option is available. These advertisements:

Are contextual and NOT behaviorally targeted based on your personal information
Are clearly distinguishable from App content
May collect device-level identifiers per Google's advertising policies
Can be limited through iOS Settings > Privacy > Apple Advertising

We do not sell your personal data to advertisers or use advertising tracking networks.

10. Location and Device Permissions

10.1 Location Services

The App requires access to your device's location to provide core navigation functionality. By using the App, you consent to:

Real-time location tracking for map positioning and route guidance
Geofencing to detect venue entry and exit for contextual features
A brief (30-second) on-device location buffer for navigation accuracy

Important: Your location data is processed on-device and is NOT stored on our servers. We do not track your location history.

10.2 Motion and Fitness Data

With your permission, the App may access device motion sensors to:

Count steps during navigation for route validation
Detect floor changes via altimeter data
Optimize suggestion timing based on activity state

Motion data is used to improve your navigation experience and is processed locally on your device.

10.3 Permission Management

You may manage App permissions at any time through iOS Settings. Note that:

Disabling location services will prevent core navigation features from functioning
Motion permissions are optional but enhance certain features
Notification permissions can be enabled or disabled without affecting navigation

10.4 Accessibility Features

The App offers accessibility routing options including:

Step-free paths using elevators instead of stairs or escalators
Accessible route preferences saved in Settings

Accessibility routing is provided as a best-effort feature. We cannot guarantee that all accessibility paths are available or accurate, as venue layouts change. Always verify accessibility options directly with venues.

11. DMCA and Copyright Infringement

11.1 Our Content Protection

We actively monitor for unauthorized use of our intellectual property. Unauthorized use of our content may result in:

Immediate termination of your App access
Civil legal action for copyright infringement
Claims for actual damages and/or statutory damages under 17 U.S.C. Section 504
Injunctive relief to stop further infringement
Recovery of attorney's fees and costs

11.2 Reporting Infringement

If you believe your copyrighted work has been infringed within our App, please contact our designated DMCA agent:

12. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

13. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We specifically disclaim:

Accuracy: Maps are for general navigation purposes and may contain inaccuracies. Venue information (hours, menus, availability) may be outdated.
Completeness: Not all areas, venues, or hotspots may be mapped.
Availability: We do not guarantee uninterrupted or error-free operation.
Fitness: We make no warranty that the App is suitable for your particular purpose.
Third-Party Content: We do not warrant the accuracy of information provided by venues or partners.

Casino venues frequently renovate and reconfigure their spaces. While we strive to keep maps current, real-world layouts may differ from App depictions.

ALWAYS USE YOUR OWN JUDGMENT AND FOLLOW ON-SITE SIGNAGE WHEN NAVIGATING.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Casino Compass, LLC, its officers, directors, employees, agents, and licensors shall NOT be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or goodwill
Personal injury or property damage resulting from your use of the App
Any errors, mistakes, or inaccuracies in content
Unauthorized access to or alteration of your data
Conduct of any third party on or related to the App
Any matter beyond our reasonable control

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST TWELVE (12) MONTHS, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Casino Compass, LLC and its officers, directors, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of a third party
Your submissions or contributions to the App
Any claim that your use of the App caused damage to a third party

16. Termination

16.1 By You

You may stop using the App at any time by uninstalling it from your device.

16.2 By Us

We reserve the right to:

Suspend or terminate your access to the App for any reason
Terminate accounts that violate these Terms
Modify, suspend, or discontinue the App (or any part) at any time
Refuse service to anyone at our sole discretion

16.3 Effect of Termination

Upon termination:

Your license to use the App immediately ends
You must stop all use of the App and delete any copies
Provisions that should survive termination (intellectual property rights, disclaimers, limitations of liability, indemnification, dispute resolution) will remain in effect

17. Modifications to Terms

We may update these Terms at any time. We will notify you of material changes by:

Posting the updated Terms within the App
Updating the “Last Updated” date
Providing notice through the App interface

Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, stop using the App.

18. Dispute Resolution

18.1 Informal Resolution

Before filing any legal claim, you agree to contact us at info@casinocompassapp.com and attempt to resolve the dispute informally for at least 30 days.

18.2 Arbitration Agreement

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration will take place in Clark County, Nevada, or another mutually agreed location
The arbitrator's decision will be final and binding
Judgment may be entered in any court of competent jurisdiction

18.3 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS ONLY. You waive any right to participate in a class action, class arbitration, or other representative proceeding.

18.4 Exceptions

The following disputes are NOT subject to arbitration:

Claims for injunctive relief to protect intellectual property rights
Claims that may be brought in small claims court

18.5 Opt-Out

You may opt out of the arbitration agreement by sending written notice to info@casinocompassapp.com within 30 days of first using the App. Your notice must include your name, address, and a clear statement that you opt out.

19. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any litigation not subject to arbitration shall be brought exclusively in the state or federal courts located in Clark County, Nevada.

20. General Provisions

20.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Casino Compass, LLC regarding the App.

20.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

20.3 Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.

20.4 Assignment

You may not assign or transfer these Terms or your rights hereunder. We may assign our rights and obligations without restriction.

20.5 Force Majeure

We are not liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet/power failures.

20.6 Notices

We may provide notices to you through the App, via email (if provided), or by posting on our website. You may contact us at info@casinocompassapp.com.
